Opting out of EU criminal justice legislation

Written Evidence Submission on behalf of the UK Independence Party by Gerard Batten MEP, spokesman on Home Affairs, stating the reasons why Britain should opt-out of all EU criminal justice legislation, and why in any areas where we wish to interact with foreign justice systems this can be done by mutual co-operation and national legislation without the need to subjugate ourselves to the EU.

The Government has invited Written Evidence submissions on the 2014 Opt-out Decision (Protocol 36).
 
This Protocol allows Britain to opt-out of certain EU inspired police and criminal justice legislation enacted after the Lisbon Treaty.
 
The most notable of which is the infamous European Arrest Warrant, which allows British citizens to be extradited without a scrap of evidence being presented to a British court.



The House of Lords Select Committee on the European Union is conducting an inquiry into this which will be presented to the Government before they make a decision by 31st May 2014. That decision allows them to opt-out of 135 legal measures, but gives them the freedom to opt back in after 2014 if they choose to do so.

It does not even address the measures enacted, or yet to be enacted, after Lisbon, for example the European Investigation Order which will put British police forces under the direction of foreign police forces.

The 2014 Opt-out issue will become an important political issue as we draw closer to the 2014 European Elections. This document will be a valuable tool to those who need to understand the issues.
